Ex and I divorced in 2010. The divorce decree stated the home was to be sold and the equity divided equally. The home was placed on the market for 11 months with only one showing. Ex stated she was on the verge of bankruptcy and needed me to do a buyout. I had an appraisal done on the home and there was only $50k equity which was about $100k less than we expected. The ex agreed to except $25k and signed a quit claim deed that stated she had been paid in full half of the equity in the home. The quit claim deed references that case number of the divorce decree. I refinanced the home (have several times now) and now over 3 years later she has filed a motion to show cause for contempt because I have not sold the home and given her half the equity minus the $25k she states was a pre-payment. Does she have a leg to stand on?
