We have a quit claim from 10 years ago. My mom in law had life use and passed in August.

My brother in law is the executor of the will
We know there is a loan on the house.
My brother in law has all the documents sent to him and did not tell us he stopped paying on the loan.
The house is going to foreclosure and the bank is refusing to talk to us or tell us how much is owed.
The taxes are in our name -- we have been paying the bill on the electricit and the oil. We have been cleaning the house and have been told that the house is ours YET the bank is still not talking to us.
I can pay the ourstanding amount to stop the foreclosure but not if I am just throughing away more money on it. PLUS they won't tell me how much to pay.

We wanted to rent the property and keep it for our son.

I have a meeting with a lawyer schedule but wanted to through this out to get some more information. It is ridiculous.

Who signed the quitclaim deed? whoever signed the quitclaim deed on that house, have no rights upon that property. But he is not immune to paying the loan or any other expences related to the property. As your brother -in-law is the executor of the will, you should talk to him about it & ask him to consult with the bank as you are willing top pay the loan installments. As per my opinion, the sooner you consult the lawer the better.
