Just saw your reply to my post short sale charged off note. You were correct. I got a letter from collection agency referencing my 2nd mortgage with Wells Fargo for $160,000. I replied to CA as requested that I am still broke. You said that WF charged it off. Who will CA want me to pay or negotiate with? Will WF file a deficiency judgement, can CA file a deficiency judgement/ or am I simply looking at a CA trying to earn a commission if they can get any money out of me?

You will have to pay off the debts to the collection agency (CA) once the debt has been charged off by the lender. If you want to negotiate regarding your debt, you will have to contact the collection agency to whom your debt has been sold off. If the CA is legal in your state, then they can take legal actions against you in order to recover the debts.
