Raymond, thank you for responding to Berly regarding mortgage fraud. Im am sure that is why my lawyer wanted me to hold off for spousal support. However the other lawyer is trying to use this dollar figure in the equitable division of the marital property. How will the mortgage company handle the 2nd mortgage if he goes to jail? I can afford the 1st mortgage myself. But not both. Will they foreclose?? I shouldn't be liable.

If the mortgage company does not receive it's payment on time, then it has the rights to foreclose the property in order to recover the debts.

Sussane: There is mortgage fraud on the part of my husband and possible collusion on part of the load officer. How can the mortgage company foreclose on a home that is under FBI investigation for fraud, for the 2nd mortgage? The 1st mortgage will be paid, but my husband committed mortgage fraud on the 2nd and on another home of ours in another state?
