You just answered my question on a quit claim and said I should go ahead and sign the claim and let the husband take my name off the loan by refinancinig. He will pay the loan as he wants the house desperately and won't pay me anything to get it. I want my name on the deed so will a judge make me do that?

It is only your decision. I only made a reference to people who have been stuck with a property that their X was suppose to keep up. If you are not going to benefit from it financially, then let it go. You dont want to be tied to a property if you will no longer have a relationship with the other party. I dont understand your last sentence, you want to be on the deed or you do not? A judge can order the house in one parties name, but for a mortgage company, a court order will not make the bank change who is responsible to the mortgage. If you want to be relieved of any liability to the property, then you want your name off the loan, and the deed (or title) to the property. Follow up if you have more questions.
