Hi, we live in florida. In 1996 my grandmother did a quick claim deed with life estate language. She put my mom on the quick claim deed. My Grandmother passed away in 2012. Now my mom owns the house. We just kept paying the mortgage for the past two years. My Grandmother's name is still on the mortgage We just went to the bank and paid off the mortgage. The mortgage department is going to put the escrow check in my Grandmother's name but we can't cash the check if it comes in my Grandmother's name. We have been paying the mortgage for the past 2 years since she passed. The life estate deed states Quote "all the estate, right, title and lien, equity and claim whatsoever of the said Grantor, either in law of equity, the only proper use, benefit and behalf of the Grantee forever" unquote. My question is doesn't this mean we are entitled to the escrow ever though the mortgage was in my Grandmother's name?
