Partiton right with loan involved

2 of three owners want to file partition right. The 3rd owner has a loan for their 1/3. The first 2 paid cash for their 1/3 each. When sold does the loan get paid first? Or do the monies get split equally and the owner with the loan is responsible for any shortfall from sale?

The loan is secured by the property not just the borrowers share of the property - there is no way a bank will allow anyone to get a cent before they collect every penny owed to them -    Good Luck Brian Barnes ENG Lending Nationwide Lender
