| DOES SIGNING THE MORTGAGE AND NOT THE NOTE OBLIGATE THE SIGNEE IN ANY WAY FOR PAYMENT OF THE LOAN...I AM MARRIED. SEPARATED. MY HUSBAND AND I LIVE IN 2 SEPARATE HOUSES. ONE HIS, ONE MINE. MINE WAS BOUGHT AFTER THE MARRIAGE IN MY NAME ONLY. I NEED TO REFINANCE. I LIVE IN ALABAMA. I AM TOLD HE HAS TO SIGN THE MORTGAGE OR WE MUST DIVORCE. RATE LOCK IS TOO SOON TO GET DIVORCE. DOES SIGNING THE MORTGAGE OBLIGATE HIM TO REPAYMENT, EFFECT HIS CREDIT REPORT IN ANY WAY IF HE DOES NOT SIGN THE NOTE. ALSO DOES THE DEED HAVE TO READ JOINT TENNANTS IF WE DO NOT LIVE TOGETHER AND HAVE SEPARATE HOMESTEADS. |

Hi lmcdmd,
If your husband's name is mentioned in the mortgage deed, then he is obligated to pay the mortgage dues. If both of you are unable to pay the mortgage, then the lender can foreclose the property which will effect your husband's and your credit report. It is not necessary that the deed has to be read as joint tenants if you do not live together.
