Huband has Passed away and Wife Still Living. Deed on Property

Title was original vested as a married man sole and separate property. Husband has now past away. What is the right form to use to put the Surviving Wife on title if she wasn't on title before?

Once again this answer for this question depends on where the property is located.

In CA, for example, to have his name removed from the title all that is necessary is a certified copy of the death certificate & a copy of a Preliminary Change of Ownership (PCOR) sent to the county recorder's office (call the correct county recorder's office for the procedure details).

If there is a home loan or mortgage encumbering the property there may be other details that need to be addressed. In some situations a loan can be called due & payable in the case of a title change.
