My question is this legal and what happens if I pay the settlement?

If HSBC has already charged off the debt to some other collection agency, then they cannot settle the debts with you. However, you can ask them to withdraw the account from collections and then negotiate with them to settle the debts. Feel free to ask if you've further queries. Sussane
