I'm closing on a short sale soon and want to take a small, landscape tree with me that was a gift from my father for my birthday. I brought this tree from my prior home. I consider it my personal property. I am replacing it with a comparable tree prior to closing.

Is this legal?

If it's planted in a container, it's "personal property" and you can take it. If it's planted in the ground, it's "real property" and you can't take it unless you have permission from the new owner.

You're welcome, Cheri. By the way, is it in the ground? If yes, please come back and let us know if the new owner said you could have it.
