My wife and I have decided to buy a condo in Arizona (we are Canadian). We decided it should be in her name only. Do we need an interspousal deed and if so for what reasons?

Hi Guest,

Welcome to Forum,

As Arizona being a community property state, even if you put your spouse's name on the title, ultimately you still own 50 % of the property even if your name is not on the title.I do not think there is any specific need for the interspousal deed as state law identifies property being owned by the family and not by an individual (specially after marriage).

Feel free to ask any further query if you have...........

Hi esc,

You can use a intespousal transfer deed to transfer property to your spouse in case of a separation. In other circumstances, you can use a quitclaim deed or a warranty deed to transfer property from one person to another.
