can I transfer my house to my husband via quitclaim or interspousal transfer deed?

I purchased a house five years ago when my husband and I had decided to split up. He signed a document (I don't remember the name of it) giving up all legal rights to the house. We have since worked things out and I have a balloon payment of the entire balance due in July. I am no longer working so I can't refinance. He can't refinance because he isn't on the deed. We thought we'd just have him buy the house from me but the bank is giving us all kinds of grief about that, like we're trying to pull something shady. Can I transfer the deed to him using an interspousal transfer grant deed or can I transfer the deed to him via quitclaim deed? We're beyond frustrated at this point and feel like our options are running out! Arizona is our state of residence.

Hi jssc,

You can use a quit claim deed in order to transfer the property to your husband's name. Once the property is transferred in his name, he will be able to refinance the mortgage. However, before doing so, I would suggest you to have a word with your real estate attorney and take his opinion in this regard.
