my mother has property Arkansas, she died a couple years ago and the property was supposed to be transferred over to my brother. He never got around to transferring the deed instead just kept paying the taxes every year. Now he has died and I am next in line for this land according to the will of my mother. My brother asked for me to give it to his son , and I have agreed to these wishes….. my question is how I go about this. It was never taken out of her name. I do have a copy of the will and the death certificates. And I have received notification to pay the taxes for this year . I figure it's best to the transferring of deed now. By the way I live in California

Hi Tony,

As there is a will, you need to probate that will. Once the probate is complete, you need to record the will at the county recorder's office and get the property transferred in your name. Then you can sign a quit claim deed and transfer your property to your brother's son. Meanwhile, you need to pay the taxes.
