Just filed Chapter 7. county records check does not show supposed 2nd mortgage lien ever being filed.

What are consequences?

My copy of note shows closing on 07/11/2005. As of this evening no mortgage to support obligation has ever been filed with the county recorder. Just shows my first mortgage.

Obviously, I am quite curious to the effect of their mistake in not filing.

Hi jgo,

The second lender will have to prove the mortgage in the bankruptcy court. If the lender is unable to prove it, then the court may strip off off the second mortgage lien from your property. Check out the given blog post to know more on this topic:
