I have owned a house for 3 years. this property was quit claimed to me and was filed into the court. The property was threatened with foreclosure. I tried to work out a short sale and was given 16 days to close on the loan, the bank would not give additional time to close on the loan. the bank foreclosed but I had already file bankruptcy. Do I have a case. I notify them of the bankruptcy but, they went ahead and foreclosed without getting the automatic stay lifted.

Welcome Elizabeth.

Has the bank just declared foreclosure? As much as I understand, the bank cannot foreclose as because bankruptcy puts an automatic stay on foreclosure. They seem to have violated the law. I think you should talk to the bankruptcy attorney as to what can be done legally.

Thanks.
