We filed a chapter 11 in 08 and was discharged in Dec of the same year. We did not reaffirm our mortgage and have not made a payment since Jan or Feb of 2009 and the bank still has not started foreclosure. When we file our 09 taxes this year do we have to do anything special? Someone told me we should have gotten a 1099 from the courts but we never have received anything except the discharge letter. Will the discharge cause us to do anything different when we file taxes this year. We live in MA

I would suggest you to contact a tax expert in this regard. He will be the best person to go though your bankruptcy details and let you know whether or not your tax filings would be different.
