My husband and I filed bankruptcy chapter 13, in 1987
A collection company has contacted me about a debt that they said I owed in 1981.
I was not married in 1981, so the letter was not sent to me in my married name.
What are my options other then hunting up the paper work.
How long can a collection agency try to collect a debt. It seems strange that after 27 years a collection company would try to collect. _________________ Need help choosing the right loan? Get free consultation from community lenders/consultant |

Hi wondering,
A collection agency can theoretically try to collect the debt forever. But you should also note that a debt can remain on your credit report for 7 years. After this statute of limitations has passed, they can't do anything to you. If the 7-year reporting cycle has passed, they have zero power. However, if you have all the documents, you should try consulting an attorney and take his advice.

Good Morning Wondering and welcome to Mortgagefit!
The first thing I would do is check your state statute of limitations on collection debts. Most states run to 5years so you would be way pass the mark. Also, make sure it's not a judgement because a judgement can be up to 10years, and can be renewed for another 10.
Either way it's far pass 20 years. Once you find out this information then you can send a 'cease and desist' letter which orders them to leave you alone.
thanks
