Me and my Ex Girlfriend purchased a car 2 years ago and both our names are on the loan and title (i could at the time purchase the car by myself but we put her name on just to make sure we got the car i made more monthly then she did)well anyways i been paying the payment since we bought it and she decided to leave me and leave me with the car that i cant afford anymore so im going to file chapter 7 on all my debt including car. My question is since her name is on the loan and title to when i file will the car go directly to her and she will have to pay the monthly payment? and will the balance on the car be completely erased from my credit since im fileing? we owe 16,000 cars worth 10,000 now. or can she sue me or anything... I need help!
i think you should go for chapter 13 as it will facilitate you to keep the car as well as new repayment options.She can't sue you for the filing of BK. :wink:

manoj has rightly said that your ex-girlfriend cannot sue you for filing bankruptcy. when you file chapter 7 bankruptcy, the trustee will sell off your property in order to pay off the creditors. when the car will be sold off, the trustee will give your ex-girlfriend her share and rest of the amount will be used in paying off your creditors.

trustee as in the "Bank" so when i file the bank with come pick up the car and auctions it off and what ever they get for it shes gotta pay the difference from what we owe and the debt will be completely wiped from my credit? and the is absolutely nothing she can do to give me back the debt right?
