Hello I am in debt and thinking of filing Bankruptcy, Mostly credit card debts, old utility bills. I am also low income and can only pay my rent and basic bills. If I were to file for Chapter 7 Bankruptcy will I still be entitled to a Tax Refund.

Hi yaqinah,

If you are filing Chapter 7 and have yet not applied for your tax returns, then the refund would be a part of your asset. You may have to surrender the tax returns to the trustee depending on the exemptions allowed in the state you file in and the trustee would use it to pay off your creditors.

Thanks
