I am in a pickle financially as most here. i am going to file bk again (last straw before i lose my house). i filed a chapter 7 in fall of 03 discharge in spring of 04. i was married and filed in my name only (i assumed a ton of debt from my wife when married in 01).

due to new laws past a couple of years ago can i file a 7 again or do i have to go with a 13? could i file a 7 jointly if the time frame is to short?

Hi baker,

As far as I know, you won't be able to file Chapter 7 bankruptcy within 8 years of your previous filing. In that case, you'll have to go for Chapter 13. This will help you in reorganizing your debts as you would get a repayment plan from the lender depending upon your financial situation in order to pay off the dues.
