Can I file Chapter 7 since Cahpter 13 has been dismissed.

My attorney is going to want to know if I want to appeal the dismissal of my Cchapter 13. What I really want to do is file for Chapter 7. I realize I will lose my condo and my car. Is this a good idea? The reason: I'm sick and tired of being stressed out from being over my head in debt.

Hi Isacmar,

I think you should be able to file Ch 7 if you have not filed Ch 7 within the past 8 years.

You may file Ch 7 if you have been dismissed from Ch 13. But it depends upon your financial condition and if you may pass the means test.

Even I think that chances of losing your condo and car are high. So, it will be better if you start looking for a home to rent with affordable monthly payments.
