can I file a second chapter 7 after 9 years of first one?

My husband and I file a bankruptcy almost 10 years ago. Now we are having financial problems and i want to know if we can qualify for another chapter 7. We have the house where we live and another property in Miami which i think is upside down on value.

Hi jmjramos,

As far as I know, you can file Chapter 7 bankruptcy. for the second time if 8 years have passed since you filed for Chapter 7. You need to contact a bankruptcy attorney and take his opinion in this regard. He would guide you as to what chapter of bankruptcy would be best suited for you.
