I filed Chapter 7 and it was discharged. My home was listed but not included and they foreclosed on it. Can they sue me?
Hi Tired,
Was the mortgage debt on your home discharged through bankruptcy? If it was, then you are no longer personally responsible for the debt. The lender can foreclose on the property to satisfy the lien, but they will not be able to sue you for any deficiency.

I have just gotten discharged in chapter 7. I looked at my credit and noticed that my mortgage was discharged. Can they make me leave my and how long would take them to do this. I live in Arizona and told they could do this?
Hi MBR,
Did you reaffirm the mortgage while in bankruptcy chapter 7? If you did not, the mortgage debt has been discharged and the lender can foreclose the home any time. Do you want to keep the house? If you do, talk with the lender and start making the mortgage payments. Once the house is foreclosed, you will have to vacate the property. Certain states have a redemption period within which you can buy back the property if you pay a certain amount of money. Check out if there is any such redemption period in your state.
