Does a bankruptcy dismissal mean I am still in bankruptcy?

Posted on: 07th Mar, 2009 09:47 am
Does a dismissed bankruptcy from 7 years ago mean I am still considered in bankruptcy because it was not discharged ?
I do not know how to use the credit tool. Do not know how to answer this.
Hi srklmak!

Welcome to forums!

Dismissal of bankruptcy does not mean that you are still in bankruptcy. Dismissal of bankruptcy means termination of the bankruptcy case. Once the bankruptcy is dismissed, the borrower and the creditors have the same rights as they had before the bankruptcy case was started.

mooom a question like that will more than likely need to be answered by your BK attorney

Mooom it alll depends on what the divorce decree states, if he files and gets discharged before your divorce is finalized you are pretty much out of luck, suggestion is both of you file that way it releives you from the debt. If you are in NC you really don't have to worry much because NC doesn't allow wage garnishments except for like court order child support etc... I specialize in bankruptcy law in Illinois.

Hi jazzy!

Welcome to forums!

Your back taxes won't be discharged in bankruptcy. You'll be liable for paying the back taxes in full to the IRS. This won't dismiss your bankruptcy filing. If you've paid all other dues as per the payment plan, you will receive a bankruptcy discharge.

Feel free to ask if you've further queries.

Hi Tabitha!

Welcome to forums!

If the bankruptcy has been dismissed, then the bankruptcy trustee won't be able to take your refund. However, your creditors can garnish the tax refund if they have received a judgment from you.

Feel free to ask if you've further queries.
