Dismiss bankruptcy filing

Posted on: 09th Mar, 2012 02:49 am
I am in a Ch 13 bankruptcy filing. I need to know how soon it will be officially dismissed. Actually I need to find a way to keep my car. I have not paid the December, January or February payment as of yet. How long, typically before my case is dismissed by the trustee??
Chapter 13bankruptcy may get dismissed immediately after you stop payments for a single month. It is strange that your bankruptcy filing haven't got dismissed yet. I guess it will get dismissed soon. Immediately after it gets dismissed, you will have to contact your car lender and try to sort out a payment plan in order to save your car from getting repossessed.

Welcome Hathway,

I agree with what our Guest poster has said. I guess your bankruptcy filing will get dismissed soon. Nevertheless, you can contact your bankruptcy attorney and take his opinion in order to find out when your bankruptcy filing can get dismissed.

You can file a Chapter 13 nearly anytime so long as no other case is pending with some exceptions.

like stated, chapter 13 can be filed immediately after you cease making payments. filing a chapter 13 bankruptcy allows you to keep your property and pay debts over time, usually three to five years. like guest said, contact your dealer and sort out a new payment plan that will better suit you.
