my mortgage was originally from Wamu, now chase bank took over the mortgage. Last July 2009 Wamu approved me for 3 month trial modification,' been paying since however, i file bk last Nov 2009. Per the bank i should continue making the trial payment while i am in bankruptcy and when Bk is over, modification will take place. Last Monday 3/1/10, i called the chase to check the status of the Bk/Modification, per the Bk rep, the loan is now in foreclosure, i was then directed to that person, Foreclosure rep said, i need to submit new docs so it can processed. Updated docs were sent last tuesday 3/2/10, tonight i received letter from Chase, informing me that house is in a Trustee sale. Now i am so confused because i dont know what to do. i really wanted to keep the house... what should i do?

What type of bankruptcy did you file? If you filed Chapter 7 and did not reaffirm the debts and stopped paying the lender, then the lender has the rights to foreclose the property. If you were paying the loan dues on time, then the lender will not be able to foreclose it.

I filed Chapter 7 but did not re-affirm (as advised by the Bk Atty) Atty stated that since loan modification had started it should be ok and continue making the payments. I have been making the payment since July 2009 until now. I contacted Chase 3/5/10 and spoke with Foreclosure Rep, the loan modification is now AGAIN assigned to a negotiator, and keep paying the mortgage while its being processed. The bank or someone posted the TRUSTEE SALE NOTICE INFRONT OF MY DOOR WITH No regards to whoever sees the notice, is this common or bank has the right to perform this action?

Though you did not reaffirm the loan, you were paying the mortgage dues. Thus, I don't think the lender should foreclose the property. I would suggest you to speak to the lender regarding the whole issue and get it resolved.
