I have been discharged form my ch. 7 bankruptcy where I surrendered my house. I had a second mortgage and was backed on my 1st by VA. I want to know how long I have before I will be forced out so I can make arrangements but it is a blessing not having to make rent or mortgage payments right now. I was told not to contact my mortgage company until they serve my forclosure notice. Can someone explain why? I have been discharged since November of 2009.

Hi Guest,

You have been discharged from bankruptcy chapter 7. But since you did not reaffirm the mortgage, the lender can foreclose your house. As you have surrendered your property while in bankruptcy, you can be forced out of the house any time. This is the reason why you have been told not to contact your lender until they send you foreclosure notice. This is to make sure that you can enjoy staying in the property without having to pay any rent or mortgage payment. However, I think you should start making arrangements to move to an alternative place of residence because a foreclosure could be imminent.
