Bankruptcy filing for medical bills

Posted on: 27th Aug, 2012 01:45 am
Due to excessive medical bills, my husband's wages were garnished and we couldn’t pay our rent and utilities. We were just barely making it before then because I lost my job due to medical issues. We filed chapter 7 at the end of July. I also applied for SSI for our disabled child. Now, when I checked the AT&T account online, instead of the $89 I owed at the time of filing, the charges are now over $1000. Are they allowed to tack on charges like that after the filing date? With the SSI issue: It's for my disabled child. We got the check and immediately bought diapers and supplies for the special needs program the child is in. Will the trustee demand the money back?
The creditor won't be able to add any further charges to your account if you have already filed bankruptcy. You should contact your bankruptcy attorney and discuss the situation with him. Apart from that, as far as SSI is concerned, I don't think the trustee will demand any money. The social security income will be exempt when you file bankruptcy.

Hello lbiza,

Make it a point that without reduced rates you will be filing for bankruptcy and they won't be receiving anything. It's in their best interest to receive at least 50 or 60% of the debt than none of it.

Hi Ibiza!

Welcome to forums!

I agree with what Niicss has said. The bankruptcy attorney will look into the whole matter and help you take the required steps against the creditor. As you're in bankruptcy, there is an automatic stay on all your creditors. So, they can't attach any fees or other amount to your existing debt.

Feel free to ask if you've further queries.
