I am on a trial period for a home modification and if I make the payments (which I will) the modification will stay permanent. Can I still file bankruptcy and keep my home after the modication?

I divorced last year, got stuck with all the debt and the house. Still owe almost $3,000 to my divorce attorney, and since I have been struggling with my mortage my credit card companies have all dropped my limit so they are all maxed out. It's a total of around $8,000. Paying minimum with high interest. The main thing for me is to keep my home. I can afford the modified payments. Especially if these other bills go away

Hi Jennifer,

You can file bankruptcy to get you discharged from the credit card debts and keep the house as well. You will have to reaffirm the mortgage with the lender. Through the reaffirmation the lender will assure you that they will not foreclose on the property until you violate the terms of the loan agreement. If the modification is made permanent, you will be able to afford the mortgage payments, right? In that case, you can simply keep making the mortgage payments as per the modified repayment plan and keep living in your house. However, you should consult a bankruptcy attorney before filing bankruptcy.

Yes I can afford the mortgage payments if the modification goes through. And yes, getting the credit cards to go away is important, along with the money I owe my lawyer still from my divorce. Thank you for your response

I am on trial period from Nov to Feb but I did not get any documentation to sign. My servicer said I will get the docs when my trial period is done. Is it really like that?
