divorced and ex filing bankruptcy

We are divorced and both names are on the mortgage. My ex has told me that he has filed bankruptcy and included the house. How is this possible when we are both listed on the mortgage.

lot more depends on which chapter BK he has filed.If he has filed chapter 7 then he need to liquidate the home asset but if he is filing chapter 13 BK then he can keep the home.

hi drayed,

i think it is possible for your ex to include the loan in his bankruptcy. as he is on the loan, he is equally responsible for the loan. it is part of the debts he owes and can thus include it in his bankruptcy. was he supposed to refinance in his name as per the divorce decree? in that case, you can file a case against him for not having refinanced the loan to release you from the liability.

I would like to advice you that, If your & your ex's name still on mortgage that means you both similarly responsible for pay mortgage.If you wants to refinance loan i will be possible.
