If you file Chapter 7 bankruptcy, you need to list all your assets. The trustee would check out as to how much he could liquidate in order to pay off your creditors. As far as the 401k hardship check is concerned, you will have to consult your bankruptcy attorney in this regard. _________________ Good is the Enemy of Great. |

You really need the assistance of a bankruptcy Attorney - please don't do this by yourself. Do you have an Attorney yet? If not, try "www.legalhelpers.com". They'll connect you with a local Attorney within 24 hours and you'll receive 30 minutes free consultation via the telephone.
