Hi, the condominium is located in Indiana. I purchased a condo with my boyfriend, his named is first on motgage my name is second, and we are now not together and have moved back to fla. the condo is listed as a short sale and there is a offer for it. I am in the middle of paying a attorney for chapter 7 bk and he asked me to sign the offer papers. I have not paid for the mortgage since the condo went listed as a short sale and as far as I know neither has he. I really dont have a problem signing the offer but dont want to mess up my bankruptcy. He says It wont affect anything because none of my bk papers have been filed yet because Im still just paying the attorney. I dont know what to do and he is kinda of pressuring me to sign. Thanks for your help.

Hi FIRE_FLY,

Unless the bankruptcy is filed, you can go ahead with the short sale. However, once the bankruptcy is filed, the court will order an automatic stay and the lender won't be able to take any actions. Thus, your short sale will be stalled.
