We will be filing for chapter7 and will surrender our home with a first and second mortgage. We have stopped making mortgage payments on both since Nov. 2010. We are upside down on both. What happens after our chapter 7 has been discharged? Can the second mort. Come after us? Or are we not liable for the second anymore since we are surrendering and not reaffirming both mortgages? Pls. Help! Thanks!

We just got our discharge papers from bankruptcy in January. We are current with our first and second mortgage. We did not reaffirm, but they are listed in our bankruptcy. I was told if we stop paying they cannot come after us because they are in our bankruptcy. So in your case I would say no the second mortgage could not come after you.
