I filed for bankruptcy in December of 10. Back in 2006 when my business was growing I borrowed $50,000 from my wife when she sold her building. As a guanentee, I signed a quick claim deed to her for my half of the home we have in florida which we live part time and my daughte rlives ther full time with her children. I stayed on the mortgage but when I filed bankruptcy, my attorney told mne I hae to list it. The quit claim was done five yaears ago this March of 2011. Yesterday my wife received a letter from the attorney of the bankruotcy court saying to her thatr it might be frausd beccause I migh be trying to get out of paying the creditors. Five years ago my company was growing fast. I was on disability and had my es xon in law running my company and it fell a little in 2007. The econony got bad and the bank pulled my line of credit for the company making it impossible to pay of even labor.

We were doing well in March of 06 and the thought of bankruptcy never crossed my mind. This attorney wants to speak to my wife. What should we do?

Hi tim!

Welcome to forums!

You will have to speak to your bankruptcy attorney and inform him about the whole situation and convince him that it was not a fraud. He will be able to help you in a better manner in this regard.
