The state has placed a lien on my Mothers house which is currently over 4 times what the house is worth. Can the Power of Attorney for my Mother deed the house over to the state now instead of waiting for my Mother to pass away. She is in a nursing home. The family can't afford the insurance and upkeep on the house and wanst to go ahead and just give it over to the state (Medicaid). Can this be done and how do you do it?

Assuming that the POA given allows such a transaction, I'd have to think that there's no reason to hold back on turning the property over to the state. It's beneficial to get a legal opinion, however, on such an important matter. I'm assuming, of course, that your Mom is not in a position to make her own decisions effectively.
