I sold my home that I had lived in for 13 years March of 2010 and my new husband and I purchased a home in April of 2010. My husband is a first time home buyer. Do we qualify for 1st or 2nd time homebuyers?

Hi kathyczarnec,

Your husband may not be considered as first time home buyer as he is purchasing the property with you. You're not a first time home buyer as you had previously owned a property of your own.

Kathy, you would be wise to contact the IRS directly or to speak to a tax advisor. If you sold your primary home in 2010 and purchased a new primary home in 2010, you may, indeed, be qualified for a tax credit. I agree with Adonis in that your husband wouldn't be able to qualify for the first-time homebuyer credit, but it's worth investigating what's available to you as an owner making a new purchase during the year.
