I sold a property in 2206 and took a frist mortgage against it. I am foreclosing on the property. What is the tax treatment on the loss? The property is worth alot less than the mortgage and they have no assets to go after.

I meant i sold the property in 2006!

Welcome to forums!

If you are forgiving the deficient amount resulting from the sale of the property, then you can send a 1099-c to the borrower. Once you send this form to the borrower, he will have to pay taxes for the forgiven amount and you can report it to the IRS as your loss. You can also contact a tax assessor and he will tell you what you need to do in this case.
