My 77 year old mother was not getting a tax bill on her property because through error the county was sending the tax bill to the person that had owned the property before her, she inquired at the county office a couple years ago and they told her not to worry if she owed taxes that she would get a bill, the property was sold in front of the court house at a tax sale in the previous owners name and the county sent this person a cert letter telling them that they would lose the property which of course they ignored....now the person that bought this property has now found my mother and tells her its his? He had a deed made....how can the county sale my mothers property without giving her notice? can she get it back?

Hi Paul,

Document evidencing the passage of title to a purchaser of property sold for taxes. The tax deed is issued upon foreclosure of the property lien. Typically, there is a grace time period permitting the owner to make good on the delinquent taxes in order to redeem the property.

It is quite surprising that they have ignored your mother and sold off the property. Your mother can take legal actions against them. I will suggest you and your mother to contact a real estate attorney and take his opinion regarding filing the lawsuit. This might help your mother to get back the property.

Time to redeem the property has passed but I have been told that if the person that bought the property didn't do proper title work and notification of of the rightful owners then the deed can be declared null and void? Of course this person(tax buyer) didn't do either of these things....I took this matter to a lawyer that said he was a real estate lawyer but I'm not sure he has ever done this kind of work before....thanks for your opinion. What a mess this is, I should have paid more attention to what my mother was doing....

It is true that if the property deed has not been recorded at the county recorder's office, then it will be considered as null and void. I would suggest you to contact another lawyer and take his opinion in this matter so that you can claim back the property.
