Does anyone know what the procedure is for obtaining title to property in California through Adverse Possession? If the 5 years have passed without any action by owner to eject possessors, has adverse possession occurred? There are still some delinquent property taxes due, however, possessors are paying current taxes and are on payment plan for remaining taxes ($11,000 past due -- should be all paid up by March or April 2009). What are chances of Court granting title to possessors in California if elements of adverse possession are met?

Hi CalGirl!

Welcome to forums!

As far as I know, according to the California laws, one has to occupy the land and claim it for the period of five years continuously and should have paid all the taxes - State, county, or municipal that has been levied and assessed upon the land or property.

You have mentioned that there are some back taxes which you need to pay. Once you pay them, then you can try for an adverse possession of the property.
