Does less valued property avoid probate?

My grandfather died in 1978 with no will and there is property in the desert that my dad lived in for 30 years and has since passed away, I take care of the property taxes and the property, My grandfathers children do not want anything to do with it and they want me to have it, I need to get it out of my grandpa's name. The value was less than 20,000 when my Grandpa died what do I need to do? I am in California

Welcome to the forum.

If the value is less than $20,000 then you can avoid probate and transferred the title to your name through "Affidavit Re Real Property of Small Value".

But the fact is you have said "The value was less than 20,000 when my Grandpa died". So is it still less than $20,000. May be not. So how much is the value of the property now?

Thank you for you reply, I would guess the property is still under 20,000 according to the tax record and everything I read says it is what the value was when the ownder deceased.

I think if the property value as you are saying is less than 20000 dollars then you can definitely use Affidavit Re Real Property of Small Value as Larry has mentioned to transfer the title to your name.

Contact with an attorney so that he can help you transfer the title on your name.
