We filed a bankruptcy in California. When do we have to be out of property?...We filed a chap 13. in Oct 2008, we are still in the property, because of financial problems. We recieved a notice of default in September. The lender has filed a motion for automatic stay to the court to be heard in January. when would we legally have to be out?

Hi moo,

Once the court gives it's judgment, the lender may ask you to move out of the property. The court may also specify a time-limit within which you will have to leave the property.
