I purchased a home with my then boyfriend in 2002 (we live in California). I have not lived in the home since March 2008 and I have not paid towards the mortgage since that time through mutual agreement. I am, however, still on the mortgage and title as he has not been able to refinance. I am now facing the real prospect of having to file bankruptcy and I am worried as to how it will affect my ex-boyfriend. I would like to know what would be my best course of action.

Hi vestdl,

As your name is on the property as well as on the mortgage, you will have to list the property as your asset and the mortgage as your debt. Depending upon the type of bankruptcy that you file, you would may lose the property. However, as your boyfriend is also an owner of the property, he may receive his share from the property sale. Your bankruptcy filing will not affect your boyfriend's credit in any way. In my opinion, both you should contact a bankruptcy attorney and discuss the case in details.
