Buying a house in a "in community state"

I come from another country and am married OUT of community of property. We settled in California which I believe is IN community of property.

I have applied to purchase a house in my own name and the offer states that it is in my own name etc. When I am applying for finance in my own name they want my spouses credit record as well (why I am not sure...)

If I purchase this in my own name, and the morgage is mine fully, what does Californian law saw about my spouse having any rights?

Hi astrab,

California is a community property state and thus your spouse will have certain rights to the property though you purchase it in your name. I guess, that's the reason why the lender wants the credit report of your spouse. You can ask your spouse to sign an inter-spousal deed in your name. This will remove your spouse's interest from the property and her credit will not be taken into account.
