Hi anybody,
I left the condo aug, 2010, Short sale didnt happen. Condo got foreclosed Feb 14,2011. HOA filed a collection suit for the unpaid HOA dues since August . As of now, no papers/docs yet as to where i stand after the foreclosure.
Do i need to get a lwyer for the civil suit. Can the HOA garnish our bank accounts or wages. Im on UI right now, but husband has a stable job.
Im already thinking of bankruptcy. Pls advise

Welcome sucala,

It will be better if you could take the help of a lawyer for your civil suit. If the HOA gets a judgment against you, then they will be able to garnish your bank accounts or wages. However, they won't be able to garnish your retirement money or pension. If you're already in bankruptcy, then you can get the HOA dues discharged in your bankruptcy filing.
