Hello, Im divorced in California. The divorce agreement reads that I will take full responsibility for the house and will refinance within 90 days to get her name off the mortgage. I attempted the refi with no luck, the house was worth less than I owed. I made the full payment of 2150 for over a year. I then attempted to remodify the morgtage, which meant being behind on payments. I informed the exwife of the situation (about missing payments to try to remod) she didnt care, she knew her credit was going to be bad for a while. The remodification process really can take a long time. I told the bank that if they could make my mortgage 1500 a month, I had no problem making the payment. The bank had me fill out numerous packages to try to qualify for different programs, all to no avail. I offered the house to the ex wife to see if she wanted to deal with it. She said no. In the meantime, I moved out and rented the property while I tried to remodify the mortgage. I would have kept the house as a rental if the remod was right. I collected rent for some period without making a mortgage payment. The house now has an auction date set and will foreclose. My ex wife says she is entitled to half of the rent I have collected and 10% interest. I think she is just mad and being money hungry. She put no effort into calling the bank or trying to remod the house. I put in countless hours in on the phone and filling out paperwork. Is she entitled to anything? She thinks I owe it to her because I ruined her credit, her credit was ruined well before I made any money on the property. I attempted to get her name off the loan, it just wasnt that easy. She made no effort to get her name off in order to keep her credit good...

Hi Guest!

Welcome to forums!

If your wife's name is on the property deed, then she is entitled to half of the rental proceeds. Her name on the property deed will make her one of the owners of the property and she will be able to claim her share.

Feel free to ask if you've further queries.
