Hi rmoney,

After the foreclosure sale is complete, the lenders will send you an eviction notice. A certain time period will be mentioned in the notice and you'll have to leave the property within that given time period. Generally, lenders give a 3 days time period to leave the property.

you eviction will take place after the FC sale. Once the property is auctioned off, and assuming there is a new 3rd party buyer, you will get your eviction notice. Or even if the property is REO or real estate owned/bank owned, you will have to vacate, but if the property is REO your can sometimes be paid to move out faster, ask your lender about that option.

? Can the reality company enter property change the locks without serving an eviction notice first. Even though we have not moved all of our property off the premises.

It is mandatory for the company to serve a eviction notice to you first. The notice would include the exact date within which you will have to leave the property. You will have to leave the property within that time period.

Welcome tiffany,

If you're already evicted from the property, then you won't have to do anything else. However, if your property has been foreclosed by the lender and you haven't moved out of it, then you would receive an eviction notice and leave the property within the given time period.

The lender will send you a registered letter mentioning the date and time within which you need to leave the property.

To Peanut,

If you're renting the property and have an agreement with the homeowner, then he cannot simply ask you to leave the property. You can contact an attorney and check out what steps you can take in this regard.

The realtor will give you an eviction notice once she buys the property from you. The notice will mention the time period within which you'll have to leave the property.

To Rebecca,

If you've defaulted on your mortgage payment, then you won't be able to object to the sale of the property.

My lender says they will evict me for not making a payment. I live in a park and am current with the space rent. I live in San Jose, Ca. I got a deferral on payments for 3 months, but did not pay on the 4th month. Does anybody know the process for this situation, and how long can the process take before I must leave?

Marlene, the process is that they'll have to go to court to move you out, so that could take quite a while. What I'd suggest in the meantime is to try and collect enough to get a payment to them right away - that's assuming, of course, that you want to stay there. That ought to, at least, stall the proceedings in your favor.
