Can a lender in California opt to sue me rather than foreclose on my house

I am trying to determine if there is any other recourse to the lender above and beyond taking my home should I fail to make the payments? If they foreclose, can they file a deficiency judgment? If not, can they opt to go after my other assets in lieu of foreclosure?

Hi Guest,

If you fail to make the payments, the lender can foreclose your property. I don't think he will directly sue you. As far as I know, California is an anti-deficiency state and the lender will not be able to come after you for the deficient amount resulting from the sale of the property.
