Can a lender in California opt to sue me rather than foreclose on my house

Guest	Posted: Mon Mar 09, 2009 3:06 pm    Post subject: Can a lender in California opt to sue me rather than foreclo Like 0 Dislike 0 I am trying to determine if there is any other recourse to the lender above and beyond taking my home should I fail to make the payments? If they foreclose, can they file a deficiency judgment? If not, can they opt to go after my other assets in lieu of foreclosure?

I don't think he will directly sue you. As far as I know, California is an anti-deficiency state and the lender will not be able to come after you for the deficient amount resulting from the sale of the property.
