My ex,lives in CAL,I Live in Seattle....

I signed a Quick claimed deed over for the house,yet she claims she can not afford to refi,,as the house is upside down?. I have a good job now2011 and want to cash in on the interest rates...for over 6 yrs i've tired to get her to refi,, But nothing,and the court cerk on the phone said i have to fly 2000 miles back and file paper work ? tonight online,,,i found a web court, site and will have to file to take her back to court? what do i file for?
As the title co, will not accept the quick claim deed to get me off the title...I can't get out from my ex she holding me,back from buying,up here,,should i file a "partition lawsuit to get her going? or what?
I just what to her out of my life,for good on paper...?

Are you saying that you are still on title to the property and on the loan? If you are on the loan, the only way off is to selll or refi. If the house is upside down, then there is really nothing you can do without, short sale, foreclosure or deed in lieu (which will all affect your credit and ability to purchase) If you are looking to purchase your own home, I would do it now, before she defaults and brings you down also. The court could force the sale, but if you have no equity, you cant sell or refi. Good luck-
