interspousal grant deed and divorce

I owned my home before my marriage. I am now getting a divorce. My husband signed an interspousal grant deed when I refinance the house. He is not on the loan or the title. Is he entitled to the equity in the home upon divorce? I live in California.

Hi minimurph,

As your husband's name is not mentioned on the property or on the mortgage and as the property was purchased before marriage, your husband is not entitled to receive any equity from that property.

Is he entitled to The worth of the home from the marriage date until the date of separation? As the home was gifted during marriage. reference to Moore vs Marsden

Apart from the worth of the home at the time of the marriage date, your spouse will also be able to receive a share of equity, if any, that has been acquired on the property.
